Cash Machine Terms – Daily Competition

Running from Friday, April 26th 2024 at 3:04pm (“Start Date”) to Friday, May 3rd at 3pm (“End Date”) (“Competition”)

1. PROMOTER

The promoter of the Competition is Bauer Media Audio Ireland LP (LP3374) acting by its General Partner, Bauer Audio Ireland Limited (701285) in association Siteridge Limited t/a Red FM (324025) and iRadio Limited (423345), all having their registered office at Marconi House, Digges Lane, Dublin 2, D02 TD60, Ireland (together, “we”, “us” or “our”).

The Competition is a Go Loud Network Competition, running across the following radio stations: Today FM, Newstalk, 98FM, SPIN 1038, SPIN South West, Red FM and iRadio.

2. DURATION

The Competition runs over consecutive rounds (each a “Round”) as described below from the Start Date to the End Date (“Entry Period”).

Entries to the Competition for each Round will open and close as follows:

first Round: opens on the Start Date and closes on the following Monday at 3:00pm;

second Round: opens on that Monday at 3:04pm and closes on the following Tuesday at 3:00pm; and

third Round: opens on that Tuesday at 3:04pm and closes on the following Wednesday at 3:00pm; and

fourth Round: opens on that Wednesday at 3:04pm and closes on the following Thursday at 3:00pm; and

fifth Round: opens on that Thursday at 3:04pm and closes on the following Friday at 3.00pm (which may be the End Date),

and so on until the End Date.

For each Round, entries received before the opening of that Round or after the closing of that Round will be invalid but the persons submitting those entries may still be charged and we will have no obligation to refund such charges.

We may make on-air announcements regarding the Competition at any time throughout each day during the broadcast schedule.

The Entry Period is final and is not impacted by the time of broadcast of announcements regarding the Competition, which may be delayed.

3. HOW TO ENTER AND COSTS

Entrants can enter each Round by sending an SMS message starting with the keyword that is announced on-air to 57557. If the message does not start with the correct keyword, or is not sent to the correct number, it will not be entered. Entrants will receive an automated SMS response to their SMS message confirming their entry. The delivery of this message may be delayed at peak times.

Entrants are responsible for all costs associated with entering the Competition. Texts cost €2.50 (from Ireland) plus standard network rate. Entrants must have permission from the bill payer before entering the Competition.

We are not responsible for any network or technical issues an entrant may experience, such as latency of the mobile phone network, which may delay or prevent their participation or cause them to not win the Competition.

4. THE DRAW AND WINNING THE PRIZE

During each Round, the prize amount (“Prize”) will be announced on air. The Prize will be the winning answer and will also be the monetary amount that entrants can win.

We may announce the Prize at any time during the Entry Period. We may also advertise the Prize on the websites and social media channels associated with our stations, via SMS marketing messages and via any other medium.

After the closing of each Round, one entrant from the valid entries will be selected by automated random draw (“Draw”). We will then call the selected entrant on the telephone number on which they have entered.

To be able to win the Prize for a Round, the selected entrant must answer their phone within five rings. The five rings will be judged according to the station’s audio (for the avoidance of doubt, the sound of a “ring ring” will count as one ring, not two).

If the selected entrant answers the call within five rings, they will be asked to name the Prize for the relevant Round. If the selected entrant correctly names the Prize, they will win the Prize. We may ask the selected entrant to repeat or confirm their answer.

If there is any doubt in relation to whether the selected entrant has correctly named the Prize or the Prize should otherwise be awarded, we may defer decision-making to an off-air adjudicator to check the audio recording with reference to these terms.

For each Round, if the selected entrant does not answer their phone within five rings or does not correctly name the Prize, they will not win the Round, and no other entrant will be called. However, the final Round (and any other Round we may nominate as a guaranteed win) is a “guaranteed win round”. For each guaranteed win round, if the selected entrant does not answer their phone within five rings or does not correctly name the Prize, they will not win the Round and we will conduct a second Draw to select a second entrant. The second entrant will then be able to win the Prize in the manner described in these terms. That process will be repeated until a selected entrant answers their phone within five rings and correctly names the Prize.

For the avoidance of doubt, the selected entrant will not be able to win the Prize for a Round if the call goes to voicemail or they fail to answer the phone at all or within five rings (according to the station’s audio) and will not win the Prize if they:

incorrectly name the Prize; or

fail to say anything at all; or

are disconnected for any reason beyond our control.

If the call goes to voicemail, we may edit the audio of the call to protect the identity of the entrant.

When there is a winner of a Round, a new Prize will be announced on-air and the then-current pool of entries for the Competition will not be valid for future Rounds or competitions. That is, persons wishing to participate in a future Draw or competition will need to enter again to be eligible to do so.

If there is no winner of a Round, there will be a rollover and we will announce a new Prize for the next Round. The Prize for the next Round will not be lower than the Prize for the previous Round. All entries from a Round, where no winner was declared, will automatically be eligible for the next Round. Entrants do not need to enter again to be eligible to win the Prize in the next Round but may do so if they would like to increase their chance of winning.

5. ENTRANT RESTRICTIONS

The Competition is only open to people aged 18 and over who: (i) live in the Republic of Ireland; (ii) are not an employee (or immediate family (including live-in partner) of an employee) of ours; and (iii) if the Competition has an associated sponsor or commercial partner, are not an employee (or immediate family (including live-in partner) of an employee) of that associated sponsor or commercial partner.

A person may enter the Competition a maximum of 12 times during each period from 3pm Friday to 3pm the following Friday. A person’s network provider may also impose limits on their ability to enter the Competition.

We may offer bonus chances to win as an incentive to enter. These incentives will be communicated via the automated SMS response confirming an entry.

It is possible to be selected more than once to play the Competition during the Entry Period and, if a selected entrant has not won the Prize in a previous Round, they are eligible to do so in a subsequent Round.

If an entrant has won the Prize in a previous Round, they are not eligible to do so in a subsequent Round. If such an entrant is selected in a subsequent Draw, that Draw will be void and we may conduct a further Draw (and the entrant will not be entitled to a refund for their entry).

If an entrant has won €500 or more in any competition conducted by us over the 6 months prior to the Start Date, they are not eligible to win the Prize. If such an entrant is selected, that Draw will be void and we may conduct a further Draw (and the entrant will not be entitled to a refund for their entry).

If we become aware, after the Prize has been awarded, that the entrant was in breach of these terms, we may withdraw the Prize from that entrant. If we become aware, after the Prize has been paid, that the entrant was in breach of these terms, we may request that the entrant repays the value of the Prize to us and, upon receipt of that request, the entrant must promptly do so. In either case, we will have no obligation to conduct a further Draw or award the Prize to any other person.

We may exclude individuals who breach these terms from entering our competitions.

6. WINNER ANNOUNCEMENT

Selected entrants will be required to talk to the presenter or programming team live on-air or off-air and the call may be recorded. Due to programming schedules, the call may not be broadcast on all participating radio stations.

By entering the Competition, entrants consent to: (a) being called; (b) their name and location being announced on-air; and (c) their name, hometown, photo and any video or audio recording of them in connection with the Competition being posted on one or more of the websites and social media channels associated with our stations.Entrants agree that we will own any such recording and that a copy of it will be stored for future use by us, which may include promotion.

7. PRIZE DETAILS

The Prize is a monetary amount that will be paid to the winner of a Round by bank transfer or cheque.

Payment of the Prize is subject to the winner of a Round providing personal identification and such personal details as we may reasonably require (including, for payment by bank transfer, bank account details) and satisfying our internal compliance checks. Payment of the Prize may take up to 28 days from the point at which we receive such identification and details.

8. GENERAL

Selected entrants will not be put through to speak on-air if we think they are driving illegally, intoxicated or likely to swear or otherwise offend our listeners. Whilst on air, selected entrants shall not use foul language, swear or say or do anything defamatory or illegal or say or do anything that would damage our reputation, is offensive or inappropriate or that would cause us, or our listeners, harm. Failure to comply will result in disqualification and, if the entrant has won the Prize, it will be forfeited.

We will only accept entries that comply with these terms and we may disqualify an entrant if we know or suspect that they have breached them. All our decisions relating to the Competition and/or awarding of the Prize are final. No discussions or correspondence with entrants or any other person will be entered into about the operation of the Competition. We may cancel or suspend the Competition or change the way it is conducted at our discretion.

We may disqualify a person from participation in the Competition (and future competitions) if we reasonably consider that person’s conduct to be contrary to the spirit or intention of the Competition, including because such person is rude or offensive to our staff.

9. DATA PROTECTION

When entering the Competition, entrants are added to our customer database and may receive service-related SMS messages. These messages will be free of charge. Entrants may opt out of receiving such messages at any time by texting: STOP to 57557. This text will be charged as a standard network rate message. Entrants may also optout of receiving such messages by visiting https://oo.fonix.com/gl and entering their mobile number.

If entrants do not wish to receive any service-related SMS messages, they will need to opt out after each time they enter the Competition. Entrants’ personal data will (regardless of whether they opt-out) always be used to process their entry.
